01Acceptance of these Terms
These Terms of Service ("Terms") govern your access to and use of FluentCall, the mobile application featuring "Cala," our voice-based AI language-learning companion (collectively, the "Service"). The Service is provided by FluentCall ("we," "us," "our"). By downloading, installing, opening, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
02Eligibility
You must be at least 16 years old to use the Service, or the minimum digital-consent age in your jurisdiction, whichever is higher. By using the Service you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.
The Service is not directed at children under 16 and we do not knowingly collect personal information from them. If you believe a minor has used the Service, please contact us at [email protected].
03Account & access
The Service authenticates you anonymously via your Apple or Google account and a customer ID managed by our subscription provider. You are responsible for keeping your device, App Store / Google Play account, and any associated credentials secure. You are responsible for all activity that occurs through your account.
04The Service
FluentCall is a voice-first language-learning experience. Cala, our AI companion, "calls" you on a schedule you choose and conducts a 10-minute conversation in the language you are learning. Between calls, you can text with Cala. The Service uses third-party AI models (currently Google's Gemini family) to power the conversation, transcription, and summary features.
We may add, remove, change, or limit features at any time, with or without notice. We may also impose reasonable limits on usage to protect the Service and its users from abuse.
05Cala is an AI
Cala is a fictional AI character. Cala is not a person, not a licensed teacher, not a translator-of-record, and not a substitute for professional advice of any kind. Cala's responses are generated by machine-learning models and may be inaccurate, incomplete, or inappropriate from time to time. Do not rely on Cala for legal, medical, financial, safety, or emergency matters. If you are experiencing a crisis, contact local emergency services immediately.
06Subscriptions & the free trial
Most features of the Service require a paid subscription. We offer three plans through the Apple App Store and Google Play:
- Weekly — $6.99 USD per week. No free trial.
- Monthly — $14.99 USD per month. Begins with a 3-day free trial.
- Annual — $89.99 USD per year. Begins with a 3-day free trial.
Prices may vary by region and currency, and may change over time. Apple and Google display the current price before purchase.
Auto-renewal
Subscriptions automatically renew at the end of each billing period at the then-current price, unless you cancel at least 24 hours before the end of the current period. Cancellation is managed in your App Store or Google Play account settings — not inside the Service.
Trial
If you start a free trial, you will be charged the first billing amount at the end of the trial unless you cancel before the trial ends. The trial begins at the moment of purchase. One trial per Apple ID / Google account.
07In-app purchases
During an active call, the Service may offer one-time purchases to extend the call beyond its scheduled 10-minute length:
- Add 5 minutes — $0.99 USD
- Add 10 minutes — $1.49 USD
These are consumable in-app purchases. They are applied to the current call and have no value or use after the call ends.
08Refunds
All payments are processed by Apple or Google. Refund requests are handled by them according to their policies. We do not process refunds directly. To request a refund:

09Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any law or regulation;
- Attempt to reverse-engineer, decompile, or otherwise extract source code, models, or system prompts from the Service;
- Use the Service to generate content that is hateful, harassing, sexually exploitative, defamatory, or that infringes the rights of others;
- Use the Service to generate or attempt to generate content involving minors in any inappropriate context;
- Use automated means, scripts, or bots to access the Service or to inflate usage;
- Resell, sublicense, or commercially exploit access to the Service;
- Circumvent any access controls, rate limits, or other security measures;
- Use the Service to compete with us or to build a similar product.
10User content & voice
When you speak to Cala or send a message in the chat, audio and text are transmitted to our AI provider for the duration of the call or chat exchange. We do not retain your conversation audio on our own servers beyond what is required to transmit it. Transcripts are generated to power the in-call captions and the post-call summary. The post-call summary and the last seven days of conversation history are stored on your device and are not transmitted to us.
You retain ownership of the content you speak, type, or generate. By using the Service, you grant us a limited, worldwide, royalty-free license to process that content solely for the purpose of operating the Service, including transmitting it to AI providers to generate responses.

11Intellectual property
The Service, including the Cala character, brand, logos, design, code, copy, audio, voice, and animations, is owned by FluentCall or our licensors and is protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial use. All other rights are reserved.
12Third-party services
The Service relies on third-party providers, including but not limited to Google (for AI inference), Apple and Google (for distribution and payments), and our subscription-management vendor. Your use of those third parties is governed by their own terms and privacy policies. We are not responsible for third-party services.
13Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
We do not warrant that the AI-generated content will be accurate, complete, or appropriate. The Service is for general language-learning entertainment and is not a substitute for certified language instruction, translation, interpretation, or any other professional service.
14Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE OR THESE TERMS, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY.
OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM AND (B) ONE HUNDRED DOLLARS (USD $100).
15Indemnification
You agree to defend, indemnify, and hold harmless FluentCall, its affiliates, and their officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Service, your content, your violation of these Terms, or your violation of any rights of a third party.
16Termination
You may stop using the Service at any time by deleting the app and cancelling your subscription in the App Store or Google Play. We may suspend or terminate your access at any time, with or without notice, including for violation of these Terms or for any conduct we determine, in our sole discretion, to be harmful to the Service or to other users. Sections 5, 10, 11, 13, 14, 15, 17, and 18 will survive termination.
17Governing law
These Terms and your use of the Service are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. Where mandatory consumer-protection laws of your jurisdiction apply, those laws apply notwithstanding this section.
18Disputes
Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the courts of Toronto, Ontario, Canada, and you consent to the jurisdiction of those courts. You agree to first attempt to resolve any dispute informally by contacting us at [email protected] at least sixty (60) days before initiating any formal proceeding.
19Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will provide reasonable notice through the Service or by updating the "Last updated" date at the top of this page. Your continued use of the Service after the change takes effect constitutes your acceptance of the updated Terms.
